I am a single mother, never married. I got pregnant from a very short term, fling-type relationship. He told me to get rid of it. I now have a 2 month old son. While pregnant I lost a job due to morning sickness and had to leave my apartment to move back in with my parents.
My sons father is suing me now, he wants my son to carry his last name, to confine my residence to a specific county, to have joint conservatorship, and he claims health care is not affordable to either of us. On the contrary, I will be going back to work February 1st and will have access to health care for my son. He is currently on medicaid until my benefits kick in next month.
As for my sons father, he claimed he wasn't sure he was the father, while standing in my delivery room the day my son was born. I agreed to paternity testing, and he was proven to be the father. I have given him and his parents visitation any time he has asked, I have been kind to him and his family throughout. He has voluntarily paid child support to me for 2 months. I have allowed him to be a father without interfering, but I do NOT want him to win this lawsuit. What are the chances that he will? What rights do his meddling parents have? What rights do I have? Also- he has a history of mental illness, was diagnosed bipolar, but does not take medication for it. It is not my intention to smear his name, but I am scared out of my mind if he is ordered to have visitation without my supervision. There have been several episodes where his mental health was in question with me and he was out of control. I understand it will be a while before he is allowed to take my son out of my home, but I want this brought up now, so it will make more sense to a judge in the future. I absolutely do not trust this man. What can I expect regarding visitation? What is joint conservatorship? Is it possible for visitation to be limited and supervised? What will I accomplish by getting a fabulous lawyer? I have no idea what to expect here.
